Juan Manuel Montes Becomes First DREAMer Deported Under Trump Administration

Advocates on Tuesday accused the government of improperly deporting a man who should have had protected status in the US - but the Department of Homeland Security disputes their claims.

When an agent asked for his ID and proof of DACA status, Montes couldn't produce it since he had left his wallet in a friend's vehicle, according to the National Immigration Law Center (NILC), an organization that represents Montes. "In addition, he has a conviction for theft for which he received probation". "Juan Manuel has been unequivocal in his assertion that he never voluntarily left the country while he had DACA", said Nora A. Preciado, a staff attorney with the National Immigration Law Center and co-counsel on the case.

Established in 2012, DACA covers some 750,000 young people brought to the U.S.as children.

USA Today reported Tuesday that Juan Manuel Montes-Bojorquez was deported on February 17 after he was stopped by a Customs and Border Protection officer in Calexico, Calif who asked for identification.

US Customs and Border Protection (CBP) officers approached him on the street in Calexico, on California's border with Mexico. The lawsuit filed in a California court on Tuesday is requesting that a judge force Customs and Border Patrol to release the information of their agent's interaction with Montes.

Curiel was assigned to the case by coincidence, USA Today reports, and according to Kari Hong-an assistant professor at Boston College Law School-it's unlikely he will recuse himself. "I miss my job".

Like President Barack Obama's administration, Trump's DHS has deported people after they lost their DACA status.

The government has issued almost 800,000 DACA permits since President Barack Obama introduced the program in 2012 and almost 700,000 renewals.

Montes's account has been disputed by the Department of Homeland Security. "We filed this lawsuit to find out how it happened".

Advertisers flee Fox's Bill O'Reilly Show amid sexual harassment lawsuits
GlaxoSmithKline said it had "temporarily put a hold" on ads on O'Reilly's show while it reviews the situation. The campaign has already tweeted support for a few of the companies who've pulled their ads from the show.

Montes, who has learning disabilities after suffering a traumatic brain injury when he was young, worked in California's agricultural fields to help support his family and studied welding at a community college before he was deported to Mexico on February 17 without explanation, his lawsuit alleges.

At least 10 Dreamers are in federal custody, according to United We Dream, an advocacy organization made up of DACA enrollees and other young immigrants, USA Today reported. He lived with his mother and younger brother, who is a USA citizen. He was twice granted DACA status, and his status is valid until 2018. Despite this, Border Patrol allegedly took him to a local station where he was asked to sign papers and then dropped off in Mexico. "The Trump administration's cruelty toward the DREAMers disgraces our values as a nation".

The Trump administration, which is taking a hard line on illegal immigration, has not dismantled DACA despite President Donald Trump's vow on the campaign trail to "immediately terminate" the program.

"It is beyond the pale that border patrol officers are left to make decisions that impact people's lives and future with absolute impunity", said Angélica Salas of the California-based Coalition for Humane Immigrant Rights (CHIRLA).
