Olivia de Havilland Sues FX Over 'Feud' Portrayal

Olivia de Havilland may be be turning 101 Saturday, but the two-time Oscar victor is not letting this chronological fact slow her down, certainly when it comes to suing FX Networks for using her as a character in its acclaimed series "Feud: Bette and Joan" and for showing her gossiping about the famously contentious relationship between screen legends Bette Davis and Joan Crawford. However, the actress is not happy with her portrayal onscreen and her lawsuit filed in Los Angeles on Friday (30Jun17) is "based on the unauthorized commercial use of Dame Olivia's name and identity in the FX (network) hit series".

Catherine Zeta-Jones played De Havilland on Feud, and the lawsuit says that she was depicted as "a hypocrite who sold gossip to promote herself".

"For almost a half a century, they hated each other, and we loved them for it", Zeta-Jones' de Havilland says in the show.

Though the show is meant to dramatize actual historical events, de Havilland said she was never consulted or asked for permission to use her identity, despite the fact that she claims she is the only survivor of the events the series depicts. "Did that happen? What was your take on that?'" Murphy said, adding, "I didn't want to intrude on Ms.de Havilland". Vanity Fair points out that Bette Davis' daughter, portrayed in the show by Kiernan Shipka, is also alive.

The actress said through a statement by her attorneys that FX never asked to use her name or identity and did not compensate her. But the film also features Catherine Zeta-Jones as De Havilland in scenes in which she discusses Davis and Crawford in a fictitious documentary.

FX and Ryan Murphy have another feud on their hands.

It argues that putting "false statements into a living person's mouth and damaging their reputation is not protected by the First Amendment because the work is cloaked as fiction".

She is suing for infringement of common law right of publicity, invasion of privacy and unjust enrichment.

De Havilland moved to Paris in the 1950s, where she now resides, and has only made rare public appearances since retiring.

De Havilland is no stranger to legal proceedings.

The two-time Oscar victor was one of the biggest stars of Hollywood's Golden Age and has appeared in more than 50 films.
