DOJ Sends Warnings to Jurisdictions Accused of Protecting Illegals

A letter from the Justice Department released Thursday said officials believe New York is violating a law requiring cooperation on immigration enforcement

Letters conveying those warnings were sent to officials in Chicago, Illinois, New Orleans, New York City, and Philadelphia.

Although the letters don't specify why the city and county are in violation of the law, the Justice Department gives them until October 27 to prove otherwise.

DOJ in its recent announcement also determined that Milwaukee County, Wisc., Clark County, Nev., Miami-Dade County, Fla., and the state of CT are in compliance with Federal law and are not guilty of sanctuary cities violations.

Landrieu added in his letter that the DOJ failed to note that the NOPD's operation manual states that officers are to follow the federal immigration statute, and that "the policy does not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, [ICE] information regarding the citizenship or immigration status, lawful or unlawful, of any individual".

Kenney has been an ardent supporter of Philadelphia's "sanctuary city" policies.

The executive order, signed by Kenney on January 4, 2016, directs Philadelphia police to disregard detainer requests unless they are supported by a judicial warrant and involve a person being released after conviction for a first- or second-degree violent felony. The Byrne grant applications "required you to comply" with the federal rules, according to the letters dated Wednesday from Acting Assistant Attorney General Alan Hanson and posted on the Justice Department Website.

Proponents of "sanctuary cities", like Kenney, say they create trust between police and immigrants, who otherwise might be afraid to report crimes. Louisiana Attorney General Jeff Landry also has pounced on New Orleans over the issue in the wake of Trump's immigration policies. One of the primary battles is that of Chicago's "sanctuary city" status. The City of New Orleans will not be side-tracked by caustic, political rhetoric that seeks to make us fearful of others and scapegoat immigrants.

The Justice Department, however, apparently has dismissed the city's earlier responses.

New Orleans City Attorney Rebecca Dietz concluded in a legal opinion that the NOPD policy does not violate federal law.

State officials denied they had ever tried to impede federal immigration investigations by refusing to share information.

"I'm not aware of any police department that releases violent criminals on the streets of America", Landrieu said at the time. The DOJ letter suggests New Orleans' failure to meet its measure of compliance could put the city at risk for losing federal grant funding.

U.S. District Judge Harry Leinenweber last month granted Emanuel a nationwide preliminary injunction preventing the Justice Department from applying new rules to grant recipients requiring them to cooperate with immigration agents to get the money.
